What is Article 4?

Article 4 Direction is a planning control that removes automatically permitted development rights in designated areas. Derby specifically targets Houses in Multiple Occupation (HMOs) in the city centre.

From 3rd of May 2025, all HMOs in these areas will need full planning permission for any changes of use or alterations, including smaller 6-person HMOs that previously didn't require permission. The council introduced this to prevent the over-concentration of HMOs and to maintain balanced communities with adequate local resources and parking.

Key Changes from May 2025:

  • Planning permission is required for all HMO conversions/modifications
  • Concentration limits: Maximum 10% HMOs within a 50m radius, no 'sandwiching,' no 3+ adjacent HMOs
  • Documentation: Comprehensive plans, statements, and reports needed
  • Timescales: 8-10 week processing with multi-department reviews
