Article 4 Direction is a planning control that removes automatically permitted development rights in designated areas. Derby specifically targets Houses in Multiple Occupation (HMOs) in the city centre.
From 3rd of May 2025, all HMOs in these areas will need full planning permission for any changes of use or alterations, including smaller 6-person HMOs that previously didn't require permission. The council introduced this to prevent the over-concentration of HMOs and to maintain balanced communities with adequate local resources and parking.
Need planning permission for any future alterations or extensions
Must secure full planning permission before converting any property to HMO use
All external modifications require planning approval, adding time and costs
Must factor in planning costs and local HMO concentration limits before purchasing
